1. Fees
• The Purchaser shall pay the Stallion Owner, upon execution, the sum of $250 as a booking fee, which is non-refundable.
• In addition to the booking fee specified above, the Purchaser promises to pay the stallion owner the sum of $250.00 as a service/stud fee, paid no later than 5 days prior to the collection of semen, unless paid by certified check or money order.
• There will be a $250 deposit required for the use of the shipping container. This deposit will be refunded in full upon return of the container, provided the container is returned undamaged within 5 days after receipt and use of the semen. For each day past 5 days, a late fee of $20 will be accrued, and the entire deposit will be forfeit if the container is not returned within 10 days. It is recommended that the mare owner insure the container for the amount of $250.
• All collection fees, FedEx fees and airline fees are to be paid to the Stallion Owner.
2. Conditions
• Stallion service will only be provided to healthy mares in sound breeding condition, as determined by a licensed veterinarian. In the event the mare is barren, a certificate of negative uterine culture (within 60 days) will be required. The veterinarian must also certify that the mare’s immunization for equine rhinopneumonitis (equine herpes type 1) have been kept current. For all mares brought to Pony Venture, LLC to be bred, a negative Coggins certificate within 12 months will be required.
• Pony Venture, LLC has the right to refuse any mare for service.
• For all mares bred away from Pony Venture, LLC, only a licensed veterinarian is to perform reproductive exams, handling of semen and insemination of said mare or all guarantees stated in this contract will be null and void.
• All mares shall be examined for pregnancy between 21 and 45 days after the last day bred, and again be reexamined between 50 and 60 days after the last day bred, and the stallion owner must be notified of her pregnancy status at that time, or all guarantees in this contract will be null and void.
• In the event the mare dies or becomes unfit for breeding, the Purchaser may substitute another mare. Purchaser must submit this request in writing and receive approval of stallion owner prior to substitution.
• The contract shall be null and void and the Purchaser shall be entitled to a refund of any fees paid hereunder if the stallion dies or becomes unfit for breeding prior to service in the current breeding season. There shall be no refund if the stallion dies or becomes unfit for breeding after semen has been shipped, or in any subsequent breeding season.
• This contract cannot be assigned or transferred by Purchaser. There shall be no right of return to the stallion if the mare is sold or otherwise changes ownership after having been served by the stallion.
3. Return of Service
• In the event that the mare aborts or fails to produce a foal that stands and nurses without assistance after foaling, the Purchaser is entitled to have the mare re-bred the following season under the following conditions:
a) If the mare is examined in foal but becomes barren during gestation, she is eligible for return if the Stallion Owner receives a veterinary certificate of barrenness within 5 days of the examination.
b) If the mare produces a live foal that is unable to stand and nurse unassisted, and subsequently dies, a veterinary certificate must be provided within 5 days from the date of death. Where appropriate, the certificate shall also confirm that the mare received proper prenatal and postnatal care and was attended at foaling.
c) If the mare is re-bred the following season, a new collection fee of $ .00 will be due.
